Andrew Cox is a Partner in the firm’s Civil Litigation group. Andrew handles a wide range of civil disputes, including those involving contracts, torts, fiduciary duties, business issues, real estate, commercial leases, trusts, insurance, and other areas. Andrew appears on behalf of clients in federal and state courts in California, as well as in mediation and arbitration. Andrew also assists clients with contentious real estate development and land use entitlement projects, especially those involving the application of state housing laws.
Before joining the firm, Andrew practiced with Irwin Fritchie Urquhart Moore & Daniels, LLC in New Orleans, Louisiana where he primarily defended medical device and pharmaceutical manufacturers in product liability lawsuits.
Andrew clerked for Judge Jacques L. Wiener at the United States Court of Appeals for the Fifth Circuit and Judge Jane T. Milazzo at the United States District Court for the Eastern District of Louisiana.
Outside of work, Andrew enjoys spending time with his family, especially outdoors hiking, fishing, and sailing, and tinkering with computer coding projects.
Representative Experience
Successfully defended business principals against multimillion dollar claims for breach of contract and fraud related to alleged vested equity takes in the liquidating sale of their business at three-week jury trial.
Successfully defended employer in a 10-plaintiff wrongful termination lawsuit, obtaining settlement on extremely favorable terms after conducting two weeks of jury trial in Los Angeles.
Prevailed at trial and on appeal in commercial unlawful detainer action on behalf of landlord, obtaining possession of the property and a near seven-figure monetary recovery.
Successfully represented developer of large mix-used housing development in federal lawsuit against neighboring opponent of development for interference with contractual and property rights and defense of neighbor’s CEQA action to stop development, obtaining favorable settlement allowing for full development of property.
Represented developer of large mixed-use housing development in negotiations with a city over the application and impact of the Housing Accountability Act, State Density Bonus Law, and other state policies promoting housing development, resulting in the city’s recognition of the developer’s unfettered rights.
Prevailed at trial in representing trustee in trust dispute involving novel question of law over will and trust interpretation, obtaining full victory validating trustee’s position.
Successfully defended real estate agents in lawsuit for negligence, personal injury, and breach of fiduciary duty arising from high-end residential lease, resulting in settlement for nominal amount.
Pursued action under City of Santa Barbara’s view ordinance through initial trial call on behalf of property owner resulting in immediate full restoration and ongoing contractual protection of client’s extensive scenic views.
Represented an international medical device manufacturer in federal multidistrict litigation over an implanted device, including as a key member of the trial team that obtained a defense verdict on the sole bellwether case.
