Brian Daly is an associate in the firm’s Labor and Employment group. Brian joined the firm in 2015. Brian’s practice is dedicated to advising employers on all aspects of the employment relationship, including hiring, personnel policies, wage and hour matters, performance management, and termination. He frequently represents employers in connection with employment-related administrative matters, including claims before the Labor Commissioner, the Department of Fair Employment and Housing, the Equal Employment Opportunity Commission, and the Agricultural Labor Relations Board. Brian also frequently represents employers in a wide variety of litigation matters, and specializes in defending employers against individual, class action, and representative (PAGA) wage and hour claims.

In his spare time, Brian enjoys surfing, playing basketball, brewing beer, and cheering on the U.S. men’s national soccer team.

Representative Experience

Reviewed and revised employee handbook and personnel policies for publicly-traded, multi-state owner/operator of various office and residential properties.
Drafted settlement agreement resolving wage and hour claims of more than 3,000 class members alleged against regional hotel management company.
Obtained decision from CA Unemployment Insurance Appeals Board upholding denial of unemployment benefits to in-home caregiver alleging she was terminated due to her criminal background.

Community Involvement

Brian currently sits on the Board of Directors of the Santa Barbara Human Resources Association as legal counsel. Brian frequently presents on employment law related topics to various trade groups and associations, including the San Luis Obispo Employer Advisory Council and the Grower Shipper Association of Santa Barbara and San Luis Obispo Counties.
